    A refugee is not the same as an immigrant. An immigrant is someone who decides to live in another country permanently. Refugees are compelled to flee their homes.

    • The Canadian refugee system is divided into two parts:
    • The Refugee and Humanitarian Resettlement Program, for those seeking asylum from countries other than Canada, and
    • The In-Canada Asylum Program, which is available to Canadians who are seeking refugee protection.

     

    • Claims for Refugees

    In most situations, a successful refugee claim will result in a person being completely entitled to become a permanent resident of Canada. In most cases, an individual is entitled for an open work permit and/or study permit while waiting for their hearing, which can take up to two years.

    • Eligibility

    There are certain limitations to filing a refugee claim, including, but not limited to:

    Having a removal order; being found to be a Convention refugee by another country to which you can travel arriving via the US-Canada border (exceptions do apply, please contact us for more details) being inadmissible to Canada on security grounds, criminal activity, or human rights violations making a prior refugee claim that was denied

    • Timelines

    A refugee claim can be filed while in Canada or at a port of entry. If a claim is made at the port of entry, the Basis of Claim form must be submitted within 15 days. A hearing date will be scheduled at some point after the application is submitted.

    The average wait time for a hearing is approximately 21 months. Some claimants will have to wait longer than others due to the complexity of the case, among other things.

    All evidence for the hearing must be filed 10 days before the hearing date. The evidence must be supplied in compliance with the immigration rules and regulations.
