    Federal Skilled Worker (FSW) Program is among the three primary immigration programs of Canada. The Federal Skilled Worker (FSW)Program is primarily developed for those immigrants who are skilled and have work experience and want to become permanent residents of Canada.

    The Federal Skilled Worker (FSW) program is among the three economic immigration programs of Canada’s Express Entry system. The Express Entry system processes the applications of Canadian permanent residence.

    The Federal Skilled Worker (FSW) uses the Comprehensive Ranking System (CRS) to rank the candidates with the highest scores in the Express Entry pool.

    • Federal Skilled Worker Program Requirements:

    The IRCC has set up a minimum eligibility requirement for the applicants to apply for the Federal Skilled Worker Program. To qualify for this program, the candidates have to meet the following requirements that are based on human capital characteristics.

    • Skilled work experience

    The applicant must possess 1 year of continuous, full-time, and skilled work experience in the National Occupational Classification (NOC) job groups.

    • Managerial jobs (skill type 0)

    • Professional jobs (skill level A)

    • Technical jobs and skilled trades (skill level B)

    Moreover, the work experience candidates possess, it must be paid, continuous, and must not be a volunteer. The work experience as a student can also be considered.

    • Language Proficiency

    The applicants are required to undertake the approved language tests for the language proficiency checkup. The language tests are for the assessment of the candidates in the following sectors of English or French language:

    • Reading
    • Writing
    • Listening
    • Speaking

    The minimum Canadian Language Benchmark (CLB) 7 in all the abilities is required. The test must be taken within the previous 2 years, and the test should be valid when you apply for the application.

    The most commonly taken language test is IELTS.

    • Education

    For education, a Canadian high school diploma or any foreign equivalent degree is required. In the case of foreign education, the candidates are required to undergo an Educational Credential Assessment (ECA). There are various degree assessment organizations from where you can get an equivalency of your degree.

    These credential assessment bodies in Canada can provide equivalence:

    • WES
    • ICAS
    • IQAS
    • CES

     

    • Proof of funds

    The primary applicant must need to demonstrate sufficient funds to support oneself or his family members when they arrive in Canada.

    • Residence in Canada:

    The applicant must have an intention to live outside the Quebec province of Canada.

    • Admissibility in Canada:

    The applicant must be admissible to Canada; he/she does not pose any threat to the country.

    • Selection Factors of FSW:

    If the candidates meet the eligibility requirements for the Federal Skilled Worker Program, then they can apply for the program.     • Language Proficiency

    The applicants should be proficient in the official language of Canada that are: English and French. The candidates can get a maximum of 28 points in language skills in English and French.

    The candidates undertake the language proficiency test i.e. IELTS. To measure English proficiency, the Canadian Language Benchmark (CLB) is used. The candidates must get a minimum level CLB 7 in all the language abilities. For the second official language, the minimum CLB 5 is required.  The score breakdown is described below.

    • Employment

    The applicants can receive points if they have a valid job offer of 1-year duration from a Canadian employer. The applicants should have a job offer before they apply to come to Canada.

    A valid job offer is considered which is a:

    • Continuous, full time and paid job (minimum 30 hours/week)
    • The job should not be seasonal
    • It should be of 1-year duration
    • It should be of Skill Type 0, A or B

    The applicants can get a maximum of 10 points for an arranged employment.

    There are 4 situations for the points. The cases are described below.

    ·         The applicant has a valid work permit when applying for a PR.

    ·         The Work Permit has been issued based on a positive Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada in an occupation listed under skill type 0 or skill level A or B of the NOC.

    ·         The applicant is working for an employer named under the applicant’s permit.

    ·         The employer had provided a valid job offer that is based on the applicant being accepted as a skilled worker.

    2.      The applicant currently works in Canada in a job that is exempt from the LMIA requirement under an international agreement (such as, the North America Free Trade Agreement) or a federal-provincial agreement.

    ·         The work permit is valid at the time of application and when the visa is issued (or you are authorized to work in Canada without a work permit when your visa is issued)

    ·         The current employer has made a permanent job offer based on the acceptance of a skilled worker

    ·         The applicant has been working for 1 year (continuous, full-time or part-time)

    3.      The candidate meets all the following requirements:

    ·         The candidates do not have a work permit, or he/she does not plan to work in Canada before getting a permanent resident visa.

    ·         An employer has an LMIA

    ·         The employer has provided a valid job offer based on that LMIA and on the applicant’s being accepted as a skilled worker.

    4.      The applicant must meet all of the following conditions:

    ·         He/she has a valid work permit or is allowed to work in Canada without a work permit.

    ·         The applicant is currently working in Canada in a job that is exempt from an LMIA, but it is not under an international, federal-provincial agreement or because of significant benefit to Canadian interests.

    ·         An employer other than the one you are currently working for:

    ·         has an LMIA

    ·         has given a valid job offer based on that LMIA and on you being accepted as a skilled worker.

    ·         Employment and Social Development Canada will only confirm valid job offers for occupations listed in skill type 0, or skill level A or B, of the NOC.

    These are the selection factors, and maximum points that the applicants can get, that is based on their characteristic.

    • FSW Application Process:

    Those candidates who are interested in applying for the Federal Skilled Worker Program, should submit their Express Entry profile to Immigration, Refugees, and Citizenship Canada (IRCC).

    After submitting the Express Entry profile, the candidates will be issued with a Comprehensive Ranking System (CRS) score. The candidates can be invited for the future Express Entry draws, and they can also get provincial nominations.

    These are the essential documents required to submit an FSW profile.
